1. Our relationship with you
The Terms of Service set out the agreement between you and TikTok in respect of your use of TikTok apps (including TikTok and TikTok Now), websites, software and related services however you access them. Our Community Guidelines also form part of our contract with you and, by agreeing to the Terms of Service, you promise to us that you will comply with them. There’s more detail on these below. Additional terms and policies might apply depending on the features you use, if you want to access additional functionality, post or live stream certain kinds of content, or use the Platform for business or commercial purposes.
You form a contract with TikTok when you accept the Terms of Service or use the TikTok Platform.
The specific TikTok company that you have a contract with depends on where you are resident.
1.1 Your responsibilities and our promises to you
- You have obligations when using the TikTok Platform:
- Our Platform and Business Model - You do not have to pay for your use of most of the features on our Platform but, in exchange, we allow some individuals and businesses to advertise on the Platform and we receive payment for this.
- Account Details - Your account is important. Keep it safe. Keep your details up to date. When you create an account in one TikTok app, you will be able to access other TikTok apps using that account (provided those apps are available in your country) and your account details, content and settings will sync across those apps.
- Minimum Age - You need to be 13 or over to use our Platform.
- Your Content - It is important that you understand what happens to the content that you create, post or share on the Platform and we have certain rules that should be followed. See more information below in the Community Guidelines section.
- Ownership of Content and Grant of Licences - When you post content to the Platform, it remains yours, but we can use it to provide the Platform and if you choose to make your content available to others, we can show it to other users and those other users may be able to use it too. That is what our Platform is all about. If you later take it down, copies of it made by other users may remain on the Platform.
- What we promise to you:
- We will always seek to provide you with a great and safe user experience, but you take the Platform as it is and understand that we do not control everything that is on it. We also cannot promise that all the content posted on the Platform is to your liking. If you are an EEA consumer, you have a legal guarantee covering the Platform, and you can make a guarantee claim by contacting us.
1.2 Changing or ending our relationship with you
- Suspending or ending our relationship.
- We want you to stay, but you can go whenever you want if you close your account and stop using the Platform. Your account applies across the Tikok app and website, TikTok Now and any other TikTok services to which you have linked your account, so when you close your account, you will lose access to your account across all TikTok services which are connected to that account.
- We have rules and, if you break them, TikTok can take action against you which may include terminating your account. See more information in the section on Actions we can take and how you can appeal.
- We may suspend or terminate your account in other circumstances, including if we are legally required to do so, or to deal with a serious technical or security issue.
- We may make changes to the Terms of Service or TikTok Platform.
- If the Terms of Service change, we will tell you. It won’t change anything between us that has happened already but, if you want to keep using the Platform in the future, you will need to agree to the changes. Our Platform will evolve as we improve it.
- Our Platform will not stay the same forever, but we will be transparent when we make major changes.
2. What you can and cannot do on the Platform
You can do many things on our Platform but you might not be able to use every feature if you are not old enough. We want you to enjoy using our Platform but, for the benefit of all our users, there are rules you need to follow.
Our Community Guidelines include rules and standards for using TikTok. They apply to everyone and everything on our Platform. Our Intellectual Property, Music and Branded Content policies may also apply, depending on the content you post.
Our Community Guidelines list the types of content you can or cannot share.
You also need to follow our Community Principles and we have rules on the following: For You feed (FYF) Eligibility Standards, Accounts, External Links, Comments and Direct Messages, TikTok LIVE and Monetization.
If you are looking for help or are experiencing some of the issues we address under our Community Guidelines, we also include quick-access links to helplines and other support resources where applicable.
We will take enforcement action if you break these rules, including restricting your content. We follow an enforcement process, detailed here. We may allow content to remain on the Platform under certain public interest exceptions. More detail here.
Our Community Guidelines also set out our approach to content moderation which is built on four pillars:
Remove violating content from the Platform if it breaks our rules.Age-restrict mature content so it is only viewed by adults (18 years and older). A summary of age-restricted content can be found here.Maintain For You feed (FYF) eligibility standards to help ensure any content that may be promoted by our recommendation system is appropriate for a broad audience. A summary of these standards can be found here.Empower our community with information, tools, and resources. For certain content, we add labels, “opt-in” screens, or warnings to provide more context or notice. Our safety toolkit helps you to filter out any content with specific hashtags or comments that you are not comfortable seeing. We also offer account controls and in-app features with safety resources.2.2 Intellectual Property
We do not allow posting, sharing, or sending any content that violates or infringes someone else’s copyrights, trademarks or other intellectual property rights. We may remove infringing user content.
You can report suspected infringements of intellectual property rights on the Platform. See more information in this section on resolving intellectual property complaints.
Our Intellectual Property Policy explains in more detail.
2.3 Music
If you are an individual and using TikTok for personal entertainment / non-commercial purposes, you can select music to include in your video from a list of music recordings in our TikTok Music Library, which we call Sounds.
If you are not an individual or are using TikTok for commercial purposes, you cannot use a music recording from the TikTok Music Library (unless you have separately obtained all necessary rights to use that music), but you can use music recordings from the TikTok Commercial Music Library (see the Commercial Music Library Terms, below).
If you include a song that was not chosen from the TikTok Music Library, then you confirm that you are the creator of that music and/or that you have all the rights and permissions needed to use that music in your video.
Unauthorised use of music may cause the video(s) to be removed or the sound(s) muted.
Our Music Terms explain in more detail.
2.4 Commercial Music Library Terms
Anyone, including businesses, can select music from our TikTok Commercial Music Library, which we call Commercial Sounds.
Music recordings selected from Commercial Music Library can be used to promote a brand or for other commercial purposes, but only on TikTok.
Unauthorised use of music may cause the video(s) to be removed or the sound(s) muted.
Our Commercial Music Library Terms explain in more detail.
2.5 Commercial Content
Whenever you post content that promotes a brand, product or service on the Platform, you must disclose that commercial relationship using the commercial content disclosure toggle within the app. The toggle is accessible within the content disclosure settings when you post a video.
If your content promotes a third party brand or its products or services in exchange for payment or any other incentive, you must also follow the specific rules in the Branded Content Policy, which include certain additional rules around the types of products and services you can and cannot promote.
3. Other ways you can use TikTok
3.1 Coins
Coins are virtual items that users may purchase (“Coins”). You can use Coins to activate certain virtual items as “Gifts” and send them to videos or live streams to show your appreciation for your favourite creators.
We have rules on how you use Coins, and can take action if you break them. You also have certain additional legal rights when you purchase Coins if you live in the EEA or the UK, and we have responsibilities. Our Coins Policy provides more detail.
3.2 Rewards
Users that participate in incentive programs offered by TikTok can receive rewards from TikTok. Some incentive programs may allow you to collect Diamonds. You can trigger payment of the monetary value given by TikTok to those Diamonds by following our Diamond payment process. We have rules on what you can do with Rewards including Diamonds, and can take action if you break them.
Our Rewards Policy explains in more detail.
3.3 Business Terms
Our Business Terms also apply if you use the Platform for purposes within your trade, business, craft or profession. Our Business Terms explain your obligations in more detail.
- Bear in mind that the products and services you access through your:TikTok For Business, TikTok Ads Manager and TikTok Business Center accounts are governed by the Commercial Terms of Service and not by the Business Terms.
- TikTok Shop Seller accounts are governed by the Seller Terms of Service and not by the Business Terms.
4. What if I have a problem?
4.1 Reporting and detecting violating content
If you discover content or accounts that may violate our rules or the law, please report it to us so we can take appropriate action. Community members can report violations in-app and on our website here.
We aim to remove violating content and accounts before they are viewed or shared. Content on TikTok is put through technology to review it. At this point it may be automatically removed or flagged to be reviewed by our trust & safety team. Additional review will occur if a video gains popularity or it has been reported.
Learn more about our enforcement efforts through our Transparency Center.
4.2 Action we can take and how you can appeal
- If you break our rules, TikTok can take action against you:
- This may include taking down content, suspending or closing your account, refusing to open a new account, or imposing limits on, or restricting your access to features of the Platform.
- If we suspect you have breached our rules, we may investigate and take down your content and suspend your access in the meantime.
When your account is suspended or closed you will lose your access to the Platform, including all TikTok apps.
If we remove or restrict access to your content, or we suspend or terminate your account, we will notify you without undue delay and state the reasons for our decision, unless it is not appropriate for us to do so (for example we are legally prevented from doing so).
If you think we have made a mistake in removing or restricting access to your content, or in suspending or terminating your account, you can appeal through the appeal functionalities provided on the Platform and we will review our decision and decide again. Further information on our complaint handling process and other redress possibilities is set out here.
4.3 How you can resolve problems and disputes
You can always contact us here: Share your feedback
The Terms of Service has a section on resolving disputes. We hope we do not get into a dispute with you but, if we do, there are a couple of ways we can try to resolve it. We will always try to first resolve it with you amicably. If we cannot resolve our dispute, you or we can go to your local courts. You can also go to the following courts:
- the courts of the Republic of Ireland will have non-exclusive jurisdiction over disputes with TikTok Ireland Limited; and
- the courts of England & Wales will have non-exclusive jurisdiction over disputes with TikTok Information Technologies UK Limited.
If you are resident in the EEA, you can also raise the dispute with an alternative dispute resolution body via the EU Commission's Online Dispute Resolution (ODR) Platform.
